Racism is a crime in Brazil, while it might not be the case in the US, this is a choice our National Congress made.

The 1988 Constitution and the Bill 7.716/89 both include racism as a crime, it is a crime without bail and with no statute of limitations.

The Brazilian Supreme Court has, since the 2000s, expanded the concept of “racism” to include antisemitism, LGBTQfobia as types of racism.

There is no violation of free speech here, simply because our society opted for including limits to the freedom of speech.

No constitutional right is absolute. Our constitution guarantees the right to freely move within national borders, but that does nor mean you can walk into any home or building. You’re guaranteed the right to own property, but that does not mean you can do absolutely anything with it.

Even the SCOTUS has been known to limit free speech, such as the fighting words, true threats and libel. Sure, the US legal system does not prohibit hate speech, but even in the Land of the Free there are limits towards the exercise of free speech.

The sentence is fair considering Brazil’s legal system.
