Highlights:
- The judge says the Carter is DISMISSED! HUGE!!!
- JUDGE SAYS OTTAWA SHOWED TRUCKS WHERE TO PARK
- Illegal use of roads included... dancing.
- ...police not wanting to move barricades because didn't have instruction to move barriers
- Acting Sergeant Blonde spoke to multiple people and none said they were there because of Chris or Tamara.
- Barber ready to move trucks again. Stopped by police. It is understandable he [Barber] would be frustrated. It was made clear OPS ended it. Barber kept up his end of bargain.
- [Cst. Bach] There were hockey games, dancing in streets. People were not aggressive.
- Barber did help move trucks
- Expression has limits. Blocking highways is not lawful. Police have the right to maintain public order. Political speech and assembly must be protected
- Both Ms Lich and Mr Barber are admitted leaders of Freedom Convoy.
- There is no question the evidence establishes the trucks and people who came to Ottawa created a mass mischief and interfered with lawful use and enjoyment of property.
- take direction from police, leave open space for emergency vehicles at all times, no closed trailers on wellington. The map also set out maximum capacity and weight for each parking areas. None of that adhered to. Ottawa police did not tell trucks to gridlock
- Barber knew what was going on. He knew what they were doing
- I accept Ms Lich and Mr Barber came with good intention and to be heard by former PM Trudeau... but they did not take any steps to alleviate [issues] until much later.
- Barber and Lich took actions to try and mitigate the situation
- Mr Barber was not a mere bystander. His presence meant something to those on the ground.
- Defence argues Barber never counseled blocking roads... video where he refers to lonely intersection. Only available inference he's sending a message to block that road. Clearly encouragement to block the road.
- As president of Freedom Convoy org, Lich was present for many press conferences, including Feb 6. Made aware of distress on residents... including on walks, known about effect on people
- There is no evidence Lich or Barber acted as principal to obstruct police. No evidence Lich interacted with police other than her arrest.
- The question is lines such as hold the line, [peace and love?], were made with intention to make it more difficult for police to effect duties
Tamara Lich BEAT 5 of 6 charges
Chris Barber BEAT 5 of 7 charges
